Linscott Gravel LIES to Idaho Department of Lands to get away from paying reclamation fees of $248,000. IDL does a fly over in 2014 and finds Linscott not being honest. Flyover indicates not 30 acres but 100 acres exposed(SEE MAP) and asks him to pay $248,000 and he doesn't qualify to pay only $450 a year. (click here for letter from IDL letting him know he is caught)
Letter is ignored by Linscott and in 2018 Frank Linscott signs and claims he went from 30 acres to 32 acres exposed - LYING so he doesn't have have money in an account for reclamation. SEE here the Post card he signs illegally claiming to Idaho Department of Lands, who has already told him they have caught him, that he only has 32 acres exposed.
After our group brings this up to IDL they then decide to confront Linscott in this letter with up to 1.8 million dollars in penalties (click here). Do they have to pay? NO, only a slap of $10,000 to continue.
Now the Linscotts are attempting an amendment which would allow IDL to be the controlling factor over their land, but they haven't followed any IDL laws since the start of getting their reclamation plan.
See here an overview of the overgrowth of the Linscott pit.
This amendment will allow the nonconforming dates for gravel pits and quarries to RESTART(illegal) in 2008 instead of when the zoning changed in 1981.
You can see Gary Allens letter here about how this is unlawful
